LOOBA Circularity

The problem

Regulation (EU) 2023/1542 on batteries and waste batteries

Directly applicable in all Member States. It replaces Directive 2006/66/EC on a staged timetable and sets sustainability, due-diligence, EPR and end-of-life rules for batteries placed on the EU market — portable, SLI, LMT, EV and industrial, including stationary storage.

Regulation (EU) 2023/1542

This is the entrance to the labyrinth: one Union act, five battery categories, and a producer obligation that still has to be performed Member State by Member State.

What to read

  • Chapter VIII EPR (Arts. 54–58), including the Art. 58(7) financial guarantee
  • Art. 44 inherited-manufacturer rule
  • Art. 55 registration in each Member State of placing on the market
  • Arts. 59–60 collection; Arts. 70–71 treatment; Art. 73 second life; Art. 77 passport
  • Arts. 74–76 reporting

Where LOOBA sits

Tier 1 — the Battery EPR Reserve — is built to discharge these obligations end-to-end for producers and asset owners of industrial batteries and BESS above 2 kWh.
